Terms and conditions
Following terms apply to all services and products sold and delivered through Horago ApS and other websites managed by Horago ApS. The terms and conditions apply to any task undertaken by Horago ApS.
Your access to and use of the website constitutes consent to be bound by these conditions, which establishes a contractual relationship between you and Horago ApS. If you do not consent to the terms, you must not access or use the website. Horago ApS can immediately terminate these terms. Horago ApS may cease to offer or refuse access to the platform at any time for any reason.
Horago ApS may from time to time change the terms. The changes to the terms will enter into force after Horago ApS publishes such updated terms in the right place. Your continued access to or use of the website after such notice constitutes the consent to be bound by the changed terms.

The provided products
Horago ApS offers a 100% software-based marketplace for the restaurant- and hospitality industry. The provided software products, facilitates orders and payments for your transactions with your customers. The solution is app-based, where the end-user can create orders directly through their smart-phone, both when the end-user is located at your premises, and also as a take-away service, when the end-user is located elsewhere.
Horago ApS also provides a comprehensive data-center, that enables you to analyze customer behavior, and general data regarding your company’s performance.
The app also includes the ability to create deals, events and offers, which the end-user can purchase immediately. Horago ApS also provides various marketing material.
Prices and payment
The applicable price is the one on the day of the order is indicated on the product concerned. All prices are exclusive VAT and are stated in DKK. Upon entering the contract, you will pay an establishing fee and hereafter you will be subject to monthly subscription fees, for being able to use and access the provided software-systems and apps. The monthly subscription fee will be paid in advance for each month or deducted from your daily payouts.
Horago ApS is free to change the stated price without prior notice. If a printing error has occurred and the buyer should know or know that this is a printing error, the buyer cannot get the price due to the printing error. Horago ApS can at any time cancel an order made by a printing error on the price.
All orders are added shipping costs. When ordering you can see the final price, which is inclusive of VAT, taxes and any shipping cost.
At Horago ApS you can make your payment through bank transfers, VISA-card and MasterCard. Horago ApS subtracts the amount, when the order is sent.
At Horago ApS, we believe that trust and confidentiality are crucial to good cooperation. All information received from you or about you will be treated confidentially, and all the employees are subject to the duty of confidentiality.
Horago ApS is not responsible for breakdowns or temporary interruptions on the platform, breakdown of power or internet connection, vandalism on the system (both physical as well as computer viruses and hacking), misuse of personal data, debit or credit cards, or other facts and circumstances that are beyond Horago ApS control. It is not guaranteed that you can use the downloaded files on any computer, and use will always assume that you are in possession of software that can open/read the relevant files.
For such damages, which are immediately covered by Act No. 481 of 7 June 1989 on product liability, the provisions of the act shall apply. For product liability which are not covered by the above-mentioned law, the following restrictions apply:
Horago ApS is only liable for personal injury if it is proved that the damage is due to error or negligence committed by Horago ApS or others Horago ApS is responsible for. Horago ApS is liable for damage on real estate and movable property under the same conditions as for personal injury. Horago ApS and the customer are mutually obliged to let themselves be summoned to the court or arbitration tribunal which examines claims against either of them on the basis of damage allegedly caused by the goods.
When purchasing access to Horago’s marketplace and apps, you will be able to access the service immediately after the purchase, unless agreed otherwise between the parties. The delivery will take place online. The delivery of marketing material will either be facilitated through Horago ApS personally or through a foreign freight carrier. The marketing material will be delivered within 7 days after the order, unless other is informed.
If the delivery is delayed, we will inform the customer by e-mail.
The end-user will usually receive delivery of their purchased products within 20-45 minutes after ordering their products. The types of delivery will vary depending on which type of delivery service the individual restaurant or hotel provides.
Right of cancellation
You have the right of cancellation at any given time after purchasing access to Horago’s software-system. You are not bound by the contract for a specific time in any way, however the initial establishing fee will not be returned upon cancellation of the contract. If you choose to cancel your contract during a month, you will not be compensated for the rest of the month, which you have already paid in advance.
Regarding the end-consumer’s purchases, the right of cancellation is wavered, as the product (food and beverage) are consumed immediately upon delivery.
Faults or Defects
If the provided software-product contains faults or defects, we will compensate the customer through their monthly subscription fees. The monthly fees will therefore be reduced with the amount of days, wherein the fault or defect has been in place. Faults or defects the end-user may experience with the products they receive from our clients, are subject to correction and compensation from the individual undertaking restaurant or hotel. The end-user should therefore contact the direct provider of their purchases and Horago ApS will in no way be liable for any faults on behalf of these providers.

Returning the marketing material
If the provided marketing material is incorrect or includes faults in any way, these can be returned to Horagao ApS, if it is proven that the inaccuracy is Horagao’s fault.
When returning the provided marketing material, you must create a return-label with Shipmondo.
Upon return, you are responsible for ensuring that the material is packed properly. You even carry the risk of the package until we receive it. You must therefore have the receipt for returning and possibly track and trace number as documentation. You bear the risk of the material from the time of delivery of the material.
You are liable for any deterioration in the value of the goods caused by handling other than what is necessary to determine the nature of the product, its properties and the manner in which it operates.
In order for you to enter into an agreement with us and use www.horago.com we need the following information about you:
Company name, company entity, corporate registration number (CVR), website, company address, company phone number), IBAN-number, account-number, reg. number, and details of the company owner(s), hereunder company owner’s full name, date of birth, address, phone number, photographic ID (for identity verification).
Any dispute arising out of your purchase through Horago ApS and on the website or the resulting disputes, including the scope or validity of these terms and conditions, is subject to Danish law and must be brought before Esbjerg City Court.
